Annie E. Catmull’s practice is primarily litigation that arises during a business entity’s restructuring efforts. For approximately 15 years, Ms. Catmull has represented creditors, trustees, creditors’ committees, landlords, tenants, asset purchasers, and debtors, within and without the bankruptcy context. Her clients are in the energy, manufacturing, real estate, telecommunications, shipping, healthcare, and personal services sectors. Much of her practice is devoted to prosecution and defense of bankruptcy preference and fraudulent transfer litigation.

Ms. Catmull was special litigation counsel for the Enron Employee Committee. On its behalf, she obtained a bankruptcy judgment disallowing the homestead claim of a former Enron officer. She was, as such, the first attorney in the U.S. to successfully exploit the 2005 amendment to the Bankruptcy Code that limits Texas homestead claims in bankruptcy cases filed by individuals who are liable for pre-bankruptcy fraud. See In re Presto, 376 B.R. 554 (Bankr. S.D. Tex. 2007).

As a contributing member of the 2004 State Bar of Texas Advanced Bankruptcy planning committee, she authored and presented “The Honest Client” at the 2004 State Bar of Texas Advanced Consumer Bankruptcy Seminar. Ms. Catmull authored and presented “Dischargeability” at the 2003 State Bar of Texas Advanced Consumer Bankruptcy Seminar. She also authored “Involuntary Bankruptcies” for presentation at the 2002 South Texas College of Law Bankruptcy Seminar and co-authored “Strategic Motions in Bankruptcy” for presentation at the 2000 University of Texas Annual Bankruptcy Conference.
